Los Angeles Slip & Fall Lawyers
Holding negligent property owners accountable when unsafe conditions cause serious injuries
Were you injured in a slip and fall? Property owners in California have a legal obligation to maintain their premises in a reasonably safe condition. When they fail — whether it’s a grocery store with an unmarked wet floor, a parking garage with broken lighting, or an apartment building with deteriorating stairs — and you’re hurt as a result, they owe you compensation. Slip and fall cases are often dismissed as minor, but the reality is far different. Falls are a leading cause of traumatic brain injuries, hip fractures, and spinal compression in adults. Valor Legal Group takes these cases seriously because we know how life-altering they can be.
What to Do After a Slip & Fall
Report the Incident Immediately
Tell a manager, property owner, or employee what happened and ask them to create an official incident report. Get a copy before you leave. This creates a contemporaneous record that the fall occurred on their property.
Photograph the Hazard
Take photos of the exact spot where you fell: the wet floor, broken tile, uneven surface, torn carpet, ice, or poor lighting. Also photograph any missing warning signs. Businesses clean up hazards quickly, so this evidence is time-sensitive.
Collect Witness Contact Information
Other shoppers, employees, or passersby who saw you fall — or saw the hazard before you fell — are critical witnesses. Get their names and phone numbers before you leave.
Seek Medical Attention Promptly
Visit an ER or urgent care clinic. Many fall injuries — especially hip fractures, compression fractures, and head injuries — worsen over time. A medical record linking your injury to the fall is essential for your claim.
Preserve Your Shoes and Clothing
The defense will argue your footwear was inappropriate. Keep the shoes you were wearing in a sealed bag. Photograph them. If they’re ordinary shoes in good condition, that undermines the “inadequate footwear” defense.
Common Slip & Fall Injuries
Hip Fractures
Falling onto a hard surface frequently fractures the hip, especially in older adults. Hip fractures often require surgical pin or joint replacement and months of rehabilitation.
Wrist & Arm Fractures
The instinct to catch yourself with outstretched hands causes Colles fractures, scaphoid fractures, and elbow dislocations that may require surgical repair.
Traumatic Brain Injuries
Striking your head on the ground or a hard surface can cause concussions, subdural hematomas, or contrecoup brain injuries — even without losing consciousness.
Spinal Compression Fractures
Landing on your back or buttocks can compress vertebrae, causing chronic pain and potentially permanent loss of height and mobility.
Knee Ligament Tears
Twisting during a fall can tear the ACL, MCL, or meniscus — injuries that often require arthroscopic surgery and six to twelve months of recovery.
Shoulder Tears & Dislocations
Falling on an outstretched arm or directly onto your shoulder can cause rotator cuff tears, labrum tears, and dislocations requiring surgical repair.
How Much Is My Slip & Fall Case Worth?
Premises liability cases depend heavily on what the property owner knew, how long the hazard existed, and the severity of your injuries.
Whether the property owner had actual knowledge of the hazard (e.g., an employee reported the spill) or constructive knowledge (the hazard existed long enough that they should have discovered it).
Duration the hazard existed. Security camera footage showing a spill sitting on the floor for 30 minutes without cleanup is powerful evidence of negligence.
Whether warning signs, barriers, or safety measures were in place. The absence of a “wet floor” sign after mopping is a clear breach of duty.
Your own awareness and actions. California’s comparative negligence rule means your compensation may be reduced if you were distracted by your phone or ignored visible warnings.
Prior incidents at the same location. If the property owner has a history of similar falls, it demonstrates a pattern of negligence.
The severity and permanence of your injuries, including surgical intervention, long-term rehabilitation needs, and impact on your daily life and employment.
